MINUTES
EASTHAM  BOARD OF HEALTH  MEETING
THURSDAY, SEPTEMBER 18, 2008
3:P.M.

PRESENT:        Dr. Stan Holt, Beverly Knox, R.N.,B.S., Jeanne Morello, R.N.,M.S.,
                Dr. James Taylor , Jane Crowely, M.S.,R.S., Health Agent        
                (Pat Lariviere, R.N. absent)

Chairman, Dr. Stan Holt opened the meeting at 3:05 p.m.


OPENING STATEMENTS:

Jane Crowley informed the Board that two residents had been exposed  to rabies. One resident was bitten by a bat, the other by a cat.  The residents were treated and tested with negative results.
The Board was informed that the rabies baiting program would take place the week of  November 3, 2008.  Volunteers from Americorps Cape Cod and Tufts Cummings School of Veterinary Medicine and other volunteers will help distribute the bait.
Jane also updated the Board about the date for Hazardous Waste Day in Orleans which is Saturday September 20, 2008.  Waste material from Eastham residents will be accepted.

Dr. Holt told the Board and the Health Agent that Howard Sandler a member of the Planning Board requested that the two Boards meet to discuss procedures to approve plans etc.
        
        Dr. Holt inquired about the dates for the flu clinics.
Jane Crowley stated  no date has been set. She will inform the Board as soon as a date has been determined.

VARIANCE
1.      Candace Bechgarrd       93 Sunset Ave           Map-19    Parcel-55

Jason Ellis presented plans to upgrade the septic system. The following variances are requested:



Proposed s.a.s. is located less than 10' from the lot line (pcl.54)- 310 CMR
        15.211 (10'/required,  5'/provided -5' variance requested.
2.     No reserve area provided -310 CMR 15.248


Proposed  s.a.s. is 51' from the top of a Coastal Bank - Eastham Board of Health Regulation (100' required-51' provided - 49' variance requested)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      Routine water quality test results be provided of existing well location to assure potability.
2.      No increase in design flow be allowed.
3.      Secondary treatment and monitoring under  general use conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate  (or 2 times per year for seasonal use)  After 2 year period of time reduction of testing  could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l .   


Operation and maintenance agreement to be submitted to Eastham Board of Health.  Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.


Deed restriction for 3 bedroom use and use alternative Advantex AX 20 System Alternative Technology requirement  to be recorded on the deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.

7.      Subject to Conservation Commission approval.


8.      Any increase in habitable square footage would require Board of Health review.


9.    Septic permit for project to be withheld until plans to deconstruct garage are              submitted.
10. Certificate of compliance of septic will nor be issued until deconstruction is completed.
Beverly Knox made the motion to approve the plans with the 10 conditions.
Dr. James Taylor seconded the motion.

POLICY ON OIL TANK  REPLACEMENT

2.      Glenn Olson, Eastham Fire Chief submitted a new form for the homeowner  to  present when requesting an extension to change or remove the  oil storage tank.
        He requested the Board vote to approve this form.
Glenn also informed the Board that the program to replace oil tanks has been  successful (515 tanks have been updated)
Jeanne Morello made the motion to approve the extension form.
Dr. James Taylor seconded the motion.
SO VOTED UNANIMOUSLY

TANK VARIANCE PLAN TO CONVERT TO GAS

3.      Jackson         2305 Herring Brook Rd           Map-10  Parcel-102
The Board approved the extension request to replace the oil tank. The new extension form will be sent to Mr.& Mrs. Jackson.

REVIEW

4.      Bianco  290 Salt Works Rd.      Map-4 Parcel-05A        
        
Jason Ellis presented revised plans to the existing dwelling and replace it with a larger one. Title 5 variances as listed per plan by Bennett & O’Reilly Engineering dated 12/22/06 were previously approved by EBOH 1/25/07.   One condition for this approval was any increase in habitable footage would require BOH review.


Finding that the plan achieves maximum feasible compliance, and the variances were previously approved by the Board 1/25/2008,with the following conditions:


Routine water quality test results be provided of existing well location to assure potability.
2.      No increase in design flow be allowed.
3.      Septitech Model M400N secondary treatment with UV treatment and monitoring under  general use conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate  (or 2 times per year for seasonal use) Effluent nitrate-nitrogen not to exceed19mg/l . After 2 year period of time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l .

7.     Approval requires confirmation for system operator that septitech Model400n is installed and functioning as required not to exceed nitrate, nitrogen 19mg/l.8.


 Subject to conservation commission approval


9.      Any increase in habitable square footage would require Board of Health review.


Beverly Knox made the motion to approve the plans with the 9 conditions.
Dr. Taylor seconded the motion.

McCutcheon      123 Bay Road            Map-7    Parcel-522

Judy Bersin submitted revised floor plans for proposed dwelling, dated 5/21/2008.  Title 5 variances as listed per plan by Bennett &0'Reilly Engineering dated 12/21/2004 was previously approved by EBOH 1/27/2005.  The revised remodeling of 1st floor eliminates 1 bedroom  and combines 2 bedrooms into one.  The second floor will have two bedrooms, and no increase in flow results from proposed plan.

        Dr. Holt read a letter from  Mr.&Mrs. Paardenkooper abutters to this property
The letter informed the Board that they have been bothered by a smell from their neighbors septic system.  They complained about the smell so their neighbors installed a charcoal filter, which helped but at times the Paardenkoopers are still bothered by the smell.
Beverly Knox  made the motion to approve the revised plans.
Jeanne Morello seconded the motion with the condition a letter be sent to Mr. & Mrs Paardenkooper.  The letter should request that they notify  the Health Department any time they are bothered by a sewer smell.  The Health Department will conduct a site inspection on request.

5A.     Jack & Miller   20 Anawon Road          Map-6    Parcel-63

The Chairman read a letter from Attorney, George B. Cavanaugh  representing the Millers requesting the Board of Health approve the plan and the inspection report submitted from Attaboy Inspection Co. The septic system is being used for 4 bedrooms and although the system was not installed as per the design plan, the capacity does accommodate the current flow based on the septic inspection.  The Board of Health reviewed the information submitted which would allow the Millers to sell their house.
Jeanne Morello made the motion to approve the plan and septic inspection report.
Dr. Taylor seconded the motion.

REDUCTION  IN TESTING


         The following property owners requests reduction in testing.

The Board approved the three  reduction requests, requiring testing 2 times per  year.  Testing shall be required in March and September for TSS, BOD, TN, nitrate-nitrogen not to exceed 19/mg/l.
Dr. Taylor made the motion for reduction of testing 2 times per year in the Month of March and September.

J.  M. O’Reilly & Associates, Inc. submitted septic system plans using Septitech Technology Model M400N at the August 28, 2008 BOH Meeting. The plans   were approved by the Board with the condition a more detail floor plan be submitted at the September BOH Meeting.
        Jane Crowley presented the plans showing more details.
Dr. Holt made the motion to approve the plan.
Dr. Taylor seconded the motion.

        CORRESPONDENCE/OTHER INFORMATION



Kristopher Smith letter was submitted to inform the Board about the possibility
        for a tattoo business in Eastham.

Set up Date for workshop to discuss Eastham Rental policy.
        The  Board decided to have the workshop on Tuesday, October 7, 2008
        at 2: p.m. in the Town Hall.

Letter from Mr. Schofield concerning the property at 31Martha Avenue Rear     will be continued and reviewed at the  October 23, 2008 Board meeting.

The meeting was adjourned at 5:15
